FIELD, Chief Justice. This is a suit in equity brought in the Superior Court to compel the defendant to convey certain real estate to the plaintiff. The case was referred to a master without any special order with respect to reporting evidence. Rule 90 of the Superior Court (1932). The defendant brought in to the master objections to his report which are appended thereto. The exceptions were overruled and the report was confirmed by an interlocutory decree from which no appeal was taken. A final decree was entered ordering conveyance of the real estate substantially as prayed for in the bill of complaint. The defendant appealed from this final decree. The contentions made by the defendant relate to procedural matters only: (a) the failure of the master to report certain evidence or the failure of the trial Judge to order such evidence reported, and (b) the admission of evidence at the hearing before the master.
